Das Angebot und der Verkauf der Artikel auf unserer Webseite ("www.MichaelMaibach.de") werden von folgenden allgemeinen Verkaufsbedingungen geregelt.

§1 Geltung gegenüber Unternehmern und Begriffsdefinitionen:
(1) Die nachfolgenden Allgemeinen Geschäftsbedingungen gelten für alle Lieferungen zwischen uns und einem Verbraucher in ihrer zum Zeitpunkt der Bestellung gültigen Fassung.
Verbraucher ist jede volljährige natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können (§ 13 BGB).
§2 Zustandekommen eines Vertrages, Speicherung des Vertragstextes:

(3) Die Präsentation der Waren in unserem Internetshop stellen kein rechtlich bindendes Vertragsangebot unsererseits dar, sondern sind nur eine unverbindliche Aufforderung an den Verbraucher, Waren zu bestellen. Mit der Bestellung der gewünschten Ware gibt der Verbraucher ein für ihn verbindliches Angebot auf Abschluss eines Kaufvertrages ab.
(4) Bei Eingang einer Bestellung in unserem Internetshop gelten folgende Regelungen: Der Verbraucher gibt ein bindendes Vertragsangebot ab, indem er die in unserem Internetshop vorgesehene Bestellprozedur erfolgreich durchläuft.
Die Bestellung erfolgt in folgenden Schritten:
1) Auswahl der gewünschten Ware über unseren Online-Shop.
2) Bestätigen durch Anklicken der Buttons „Zum Warenkorb hinzufügen“
3) Prüfung der Angaben im Warenkorb und die Bestätigung durch den Button „Kasse“.
4) Anmeldung im Internetshop nach Registrierung und Eingabe der Anmeldeangaben (E-Mail-Adresse, Adresse, …).
5) Nochmalige Prüfung bzw. Berichtigung der jeweiligen eingegebenen Daten. ("Shipping", "Payment", Daten, Einverständnis-Kontrollkästchen und ggf. Rabattcodes).
6) Verbindliche Absendung der Bestellung durch Anklicken des Buttons „kostenpflichtig bestellen“ bzw. „Purchase“. (Durch die Bestellung stimmen Sie unsere Richtlinien und AGB’s zu!)
Der Verbraucher kann vor dem verbindlichen Absenden der Bestellung durch Betätigen der in dem von ihm verwendeten Internet-Browser enthaltenen „Zurück“-Taste nach Kontrolle seiner Angaben wieder zu der Internetseite gelangen, auf der die Angaben des Kunden erfasst werden und Eingabefehler berichtigen bzw. durch Schließen des Internetbrowsers den Bestellvorgang abbrechen. Wir bestätigen den Eingang der Bestellung unmittelbar durch eine automatisch generierte E-Mail („Bestellbestätigung“). Mit dieser nehmen wir Ihr Angebot an. Sollten Sie aus bestimmten Gründen, negativ in unserer Datei vermerkt sein, wie z.B. durch offene Rechnungen, werden wir Ihre Anfrage nicht annehmen, daher entsteht keine Einwilligung durch unsere Seite und Sie erhalten so eine manuelle Auftragsstornierung. Bitte haben Sie dafür Verständnis.
(5) Speicherung des Vertragstextes bei Bestellungen über unseren Internetshop: Wir speichern den Vertragstext und senden Ihnen die Bestelldaten, die Rechnung und unsere AGB per E-Mail zu. Die AGB können Sie jederzeit auch unter http://www.michaelmaibach.de/agb einsehen.
(5A) Aus Umweltschutz- Gründen erhalten Sie die Rechnung nur an die von Ihnen angegebener E-Mail, bei der Versendung Ihrer Bestellung zugeschickt.
(6) Kauf eines Samples für eine Zusammenarbeit kann bei beidseitigem Interesse
vorgenommen werden. Sample Sales sind angepasste Preise, die eine Zusammenarbeit ermöglicht. Hier wird vom Käufer bestätigt, dass er auf eine Materialzusammensetzung der Kleidungsstücke verzichtet. Fotos mit den angezeigten Kleidungsstücken sind nur nach Kauf der Ware möglich zu veröffentlichen. Das bedeutet die Ware muss bezahlt und vom Rückgaberecht ausgeschlossen sein. Auch Prototypen gehören zu dieser Regelung.
§3 Preise, Versandkosten, Zahlung, Fälligkeit:
(1) Alle angegebenen Preise sind in Euro-Beträge und enthalten die deutschen gesetzliche 19% Umsatzsteuer/Mehrwertsteuer und sonstige Preisbestandteile. Hinzu kommen etwaige Versandkosten.
(1A) Bei bestimmten Aktionen wie z.B. Rabatte oder kostenlosen Versand, erhalten Sie den angebotenen Prozentsatz abgezogen. Dies passiert nicht automatisch, sondern der gültige Code muss an der Kasse/Checkout im Rabattfenster eingegeben werden. Sie haben so auch kein Recht auf eine Erstattung des Betrages oder Versandkostenbetrag, ein solcher ist nämlich gerade nicht angefallen.
(2) Der Verbraucher hat die Möglichkeit die Zahlung per Mastercard, Visa und PayPal durchzuführen.
(3) Der angegebene Betrag an der Rechnung, wird per Sofort- Bezahlung vom jeweiligen ausgewählten Bezahlungsart abgebucht.
Zahlungsverpflichtung und Mahnlauf: Sie sind verpflichtet, den Kaufpreis binnen 7 Tagen an uns zu entrichten. Für den Fall, dass Sie Ihrer Zahlungspflicht nicht wie auf der Rechnung festgelegt nachkommen, sind wir berechtigt, wöchentliche pauschalierte Mahngebühren als Verzugsschaden geltend zu machen.
Die Mahngebühren betragen wie folgt:
1. Mahnung. (am 1. Tag des Verzugseintritts): EUR 5,00
2. Mahnung. (am 8. Tag des Verzugseintritts): weitere EUR 5,00
3. Mahnung. (am 15. Tag des Verzugseintritts): weitere EUR 5,00
Weitere Inkassogebühren können anfallen, Rücklastschriftgebühren fallen nicht an.
(4) Im Falle das der Verbraucher bei uns als ‘negativ’ vermerkt ist (d.h. negative Verkaufserfahrung wie z.B.: nicht bezahlen einer früheren Bestellung), sind wir dazu berechtigt die Bestellung nicht zu verarbeiten und ggf. zu stornieren. In solch einem Fall erhält der Verbraucher eine E-Mail mit dem Abbruch der Bestellung und somit auch keine Ware, die von ihn betätigte Vorausbezahlung wird ggf. zurückerstattet.
(5) Zahlung: Wir akzeptieren Zahlungen per PayPal und Stripe.
a) Zahlung per PayPal:
PayPal: Sie bezahlen den Rechnungsbetrag über den Online-Anbieter Paypal. Sie müssen sich bei PayPal registrieren bzw. dort registriert sein, um sodann mit Ihren Zugangsdaten legitimieren und die Zahlungsanweisung an uns bestätigen. PayPal stellt hierzu die Rahmenbedingungen für die Nutzung. Sie können die Summe über Ihren PayPal Guthaben, oder per Banküberweisung bezahlen. Weitere Hinweise erhalten Sie im Laufe des Bestellvorgang. Nachdem der Betrag auf unserem Konto eingegangen ist, wird die Bestellung aktiv bestätigt und wir erhalten die Auftragsbestätigung
a) Zahlung per Stripe:
Stripe (Kreditkarte, Apple Pay, giropay, SOFORT): Stripe ist ein Online-Bezahldienstleister für Kreditkarten, Apple Pay, SOFORT, giropay und viele andere. Sie registrieren sich hierzu einmalig mit Ihren Bankdaten und können zukünftig mit der hinterlegten E-Mail-Adresse und Passwort bezahlen. Sie können die angebotenen Zahlungsarten jedoch auch ohne einen Account nutzen. Stripe dient dabei nur als Zahlungsdienstleister. Mehr Infos zu Stripe gibt es hier.
Im Falle einer Retoure: Sobald die Retoure bei uns angekommen ist, bearbeiten wir diese und die Rückerstattung erfolgt direkt über Stripe.
Bitte beachte, dass die Zahlungsbestätigung über die Zahlungsart SOFORT bis zu zwei Tage in Anspruch nehmen und somit den Versandprozess verzögern kann.
§4 Lieferung:
(1) Die Lieferung erfolgt nach Fertigstellung des Produktes. Bitte haben Sie Verständnis, dass es sich hier um circa sieben bis 14 Werktagen handeln kann, da wir ein Qualitätsprodukt herstellen, und ausliefern möchten, damit Sie ein gutes Produkt erhalten werden. Der Paket-Versand wird zusätzlich ungefähr drei bis vier Werktagen in Anspruch nehmen. Dabei beginnt die Herstellungszeit am Tag nach Bestelleingang. Fällt dieser Tag des Bestelleinganges auf einen Samstag, Sonntag oder gesetzlichen Feiertag, verzögert sich dieser um diese Tage.
(2) Die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung der verkauften Sache geht auch beim Versendungskauf erst mit der Übergabe der Sache an den Käufer auf diesen über.
(3) Die von Ihnen erhaltene Ware muss bei Erhalt unverzüglich kontrolliert werden um mögliche Mängel festzustellen. Sollte dies der Fall sein, so muss eine E-Mail an uns gesendet werden. Bitte beachten Sie hier den Punkt ‘Widerrufsrecht’. Sie haben so das Recht die Ware wieder an uns zurück zu senden, die von uns geprüft wird. Ergibt die Prüfung einen Sachmangel und damit die Begründetheit des Käufervorwurfs, werden wir für die Einsendekosten aufkommen und Sie erhalten ggf. eine neue Ware.
Ist das Gegenteil der Fall und die Ware wurde mutmaßlich beschädigt oder genutzt und weist so Gebrauchsspuren, obliegen diese dem Käufer und können nachträglich nicht vom Käufer zurückgefordert werden, die Ware wird daher wieder an den Verbraucher/Käufer zurückgesendet und es entsteht keine Warenrücknahme gegenüber dem Verkäufer. Kommt es nach einer Mängelprüfung zur Rücksendung zum Käufer, trägt die Kosten dafür der Verbraucher/Käufer, wenn kein Sachmangel bestätigt werden konnte, oder Gebrauchsspuren festgestellt werden und der Händler ihm den Besitz am Eigentum wieder einräumen will.
(4) Für den Fall, dass wir die geschuldete Leistung aufgrund höherer Gewalt (insbesondere Naturkatastrophen) nicht erbringen können, sind wir für die Dauer der Hinderung von der Leistungspflicht befreit. Ist uns die Ausführung der Bestellung bzw. Lieferung der Ware länger als einen Monat aufgrund höherer Gewalt unmöglich, sind Sie zum Rücktritt vom Vertrag berechtigt.
(5) Versand und Zahlungsbedingungen:
‘Michael Maibach’ wird Ihre Bestellung immer so schnell wie möglich versenden. Die Angaben über die Lieferfristen sind unverbindlich. Wie bei § 4 Absatz (1) schon vermerkt, wird das Produkt nach Bestelleingang für Sie produziert. Nach Produktion wird Ihre Ware verpackt und an den Versand-Anbieter übergeben.
-Für Lieferungen innerhalb Deutschlands, bietet Michael Maibach kostenfreuen Hinsende-Versand ab einen Warenwert von 50€ an. Für Standard Versand unter dem genannten Warenwert betragen die Versandkosten 6 Euro.
-Für Lieferungen nach Österreich betragen Versand- und Verpackungskosten mit Standardversand unabhängig vom Bestellwert pro Verpackungseinheit 9,80 €.
-Internationale Sendungen nach Tschechische Republik, Ungarn, Belgien, Dänemark, Frankreich, Spanien, Polen, Italien, Niederlande, Schweden und Kroatien können nur mit Standardversand bestellt werden. Hier betragen die Versand- und Verpackungskosten unabhängig vom Bestellwert pro Verpackungseinheit 15,00 €.
-Es erfolgt keinen Versand in nicht aufgezählten Ländern.

§5 Eigentumsvorbehalt:
Wir behalten uns das Eigentum an der Ware bis zur vollständigen Bezahlung des Kaufpreises vor.
Sollten Rechnungen nicht beglichen werden können, hat 'Michael Maibach' das Recht, die bestellte Ware wieder einzuholen.
Rücksendepflicht binnen 7 Tage nach Email Zahlungserinnerung/Rücksendeangebot.
Wurde eine Teilzahlung gemacht, hat 'Michael Maibach' das Recht die Summe aufzuteilen, d.h. die fehlende Summe in der Rechnung wird aufgeteilt und mit der Teilzahlung verglichen, die bestimmten Artikeln die nicht in der Bezahlsumme stecken, muss an 'Michael Maibach' zurück gesendet werden. (Kosten übernimmt in diesem Fall der Käufer).
§6 Widerrufsrecht des Kunden als Verbraucher:
Widerrufsrecht für Verbraucher: Verbrauchern steht ein Widerrufsrecht nachfolgender Maßgabe zu, wobei Verbraucher jede natürliche Person ist, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können.
Widerrufsrecht:
Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen.
Die Widerrufsfrist beträgt vierzehn Tage, ab dem Tag, an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die Waren in Besitz genommen haben bzw. hat.

mittels einer eindeutigen Erklärung per E-Mail über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist.
Widerrufsfolgen:
Wenn Sie diesen Vertrag widerrufen, werden wir Ihnen die Zahlungen, die wir von Ihnen erhalten haben, ausschließlich der Lieferkosten, unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags und der Ware bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.
Wir können die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben und die Ware von der Vollständigkeit und der vollen Qualität kontrolliert haben. Sie müssen für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist. Das bedeutet die von Ihnen bestellte Ware muss den Original Zustand haben. (Etikett darf nicht abgeschnitten sein, die Ware darf nicht gewaschen oder gebügelt sein.)
Sie tragen die unmittelbaren Kosten der Rücksendung der Ware.

§8 Vertragssprache und Vertragsspeicherung:
Als Vertragssprache steht ausschließlich in Deutsch und Englisch zur Verfügung.
Der Vertragstext ist gespeichert und kann nach Abschluss des Bestellvorgangs online abgerufen werden. Sie erhalten bei jeder Bestellung eine Kopie der AGB mit der Rechnung per E-Mail zugesendet.
§9 Anwendbares Recht:
Die Beziehungen zwischen uns und dem Kunden unterliegen dem Recht der Bundesrepublik Deutschland. Das UN-Kaufrecht, sowie sonstige, auch künftige zwischenstaatliche oder internationale Übereinkommen finden, auch nach ihrer Übernahme in das deutsche Recht, keine Anwendug.
Gerichtsstand für alle Streitigkeiten im Zusammenhang mit dem Liefergeschäft ist nach unserer Wahl Nagold, für Klagen des Kunden ausschließlich Nagold. Gesetzliche Regelungen über ausschließliche Zuständigkeiten bleiben unberührt. Diese Gerichtsstandsvereinbarung gilt nicht für Kunden, die Nichtkaufleute sind.

Wir sind nicht bereit und nicht verpflichtet an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
§ 10 Schlussbestimmung:
Der Vertrag bleibt auch bei Unwirksamkeit einzelner Bedingungen in seinen übrigen Teilen verbindlich. Sollte eine Regelung ganz oder teilweise unwirksam sein, so werden sich die Vertragspartner unverzüglich bemühen, den mit der unwirksamen Regelung erstrebten wirtschaftlichen Erfolg auf andere, rechtlich zulässige Weise zu erreichen.

(6) Purchase of a sample for a cooperation can be made in case of mutual interest.

§3 Prices, shipping costs, payment, due date:
(1) All stated prices are in Euro amounts and include the German statutory 19% sales tax / value added tax and other price components. In addition, there are any shipping costs.
(1A) For certain promotions such as discounts or free shipping, you will receive the percentage offered deducted. This does not happen automatically, but the valid code must be entered at checkout/checkout in the discount window. Thus, you also do not have the right to a refund of the amount or shipping costs, such an amount is just not incurred.
(2) The consumer has the option to make the payment by Mastercard, Visa and PayPal.
(3) The specified amount on the invoice, will be debited by instant payment from the respective selected payment method.
Payment obligation and reminder run: You are obliged to pay the purchase price within 7 days to us. In the event that you do not meet your payment obligation as specified on the invoice, we are entitled to claim weekly flat-rate reminder fees as damages for delay.
The reminder fees are as follows:
1st reminder. (on the 1st day of default): EUR 5.00
2nd reminder. (on the 8th day of default): further EUR 5.00
3rd reminder. (on the 15th day of default): further EUR 5.00
Further collection fees may apply, return debit note fees do not apply.
(4) In case the consumer is registered with us as 'negative' (i.e. negative sales experience such as: non-payment of a previous order), we are entitled not to process the order and to cancel it if necessary. In such a case, the consumer will receive an e-mail with the cancellation of the order and therefore no goods, the prepayment operated by him will be refunded if necessary.
(5) Payment: We accept payments via PayPal and Stripe.
a) Payment by PayPal:
PayPal: You pay the invoice amount through the online provider PayPal. You must register with PayPal or be registered there to then legitimize with your access data and confirm the payment instruction to us. PayPal provides the general conditions of use for this purpose. You can pay the amount via your PayPal balance, or by bank transfer. You will receive further instructions in the course of the ordering process. After the amount is received on our account, the order is actively confirmed and we receive the order confirmation
a) Payment by Stripe:
Stripe (credit card, Apple Pay, giropay, SOFORT): Stripe is an online payment service provider for credit cards, Apple Pay, SOFORT, giropay and many others. You register for this once with your bank details and can pay in the future with the stored email address and password. However, you can also use the payment methods offered without an account. Stripe only serves as a payment service provider. More information about Stripe can be found here.
In case of a return: as soon as we receive the return, we will process it and the refund will be made directly through Stripe.
Please note that the payment confirmation via the SOFORT payment method may take up to two days and thus delay the shipping process.
§4 Delivery:
(1) Delivery will be made after completion of the product. Please understand that this may take about seven to 14 working days, because we want to produce a quality product, and deliver so that you will receive a good product. Package shipping will take about three to four business days in addition. In this case, the manufacturing time starts the day after the order is received. If this day of order receipt falls on a Saturday, Sunday or public holiday, it will be delayed by these days.
(2) The risk of accidental loss and accidental deterioration of the sold item shall not pass to the Buyer until the item is handed over to the Buyer, even in the case of a mail-order purchase.
(3) The goods received by you must be checked immediately upon receipt in order to determine possible defects. Should this be the case, an e-mail must be sent to us. Please note here the point 'right of withdrawal'. So you have the right to send the goods back to us, which will be checked by us. If the inspection shows a material defect and thus the validity of the buyer's accusation, we will pay for the sending costs and you will receive a new product if necessary.
If the opposite is the case and the goods were presumably damaged or used and thus show signs of use, these are the responsibility of the buyer and cannot be subsequently reclaimed by the buyer, the goods are therefore returned to the consumer/buyer and there is no return of goods against the seller. If it comes after a defect inspection to the return to the buyer, the costs for this are borne by the consumer / buyer, if no material defect could be confirmed, or traces of use are found and the dealer wants to give him the possession of the property again.
(4) In the event that we are unable to perform the service owed due to force majeure (in particular natural disasters), we shall be released from the obligation to perform for the duration of the hindrance. If the execution of the order or delivery of the goods is impossible for us for more than one month due to force majeure, you are entitled to withdraw from the contract.
(5) Shipping and payment terms:
'Michael Maibach' will always ship your order as soon as possible. The information about the delivery times are not binding. As already noted in § 4 paragraph (1), the product will be produced for you after receipt of your order. After production, your goods will be packed and handed over to the shipping provider.
-For deliveries within Germany, Michael Maibach offers free shipping from a value of goods of 50 €. For standard shipping below the mentioned value of goods the shipping costs are 6 Euro.
-For shipments to Austria, shipping and handling costs with standard shipping regardless of the order value per packaging unit is 9.80 €.
-International shipments to Czech Republic, Hungary, Belgium, Denmark, France, Spain, Poland, Italy, Netherlands, Sweden and Croatia can only be ordered with standard shipping. Here, the shipping and packaging costs are € 15.00 per packaging unit, regardless of the order value.
-There is no shipping in countries not listed.

§5 Retention of Title:
We retain title to the goods until the purchase price has been paid in full.
If invoices cannot be settled, 'Michael Maibach' has the right to recover the ordered goods.
Return obligation within 7 days after email payment reminder/return offer.
If a partial payment has been made, 'Michael Maibach' has the right to split the sum, i.e. the missing sum in the invoice will be split and compared with the partial payment, the certain items that are not in the payment sum must be sent back to 'Michael Maibach'. §6 Right of withdrawal of the customer as a consumer:
Consumers are entitled to a right of revocation of the following condition, where consumer is any natural person who enters into a legal transaction for purposes that can be attributed predominantly neither to their commercial nor their independent professional activity.

You have the right to revoke this contract within fourteen days without giving any reason.

Consequences of revocation:
If you revoke this contract, we will refund the payments we have received from you, excluding delivery costs, without undue delay and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract and the goods. §8 Contract language and contract storage:
The contract language is exclusively available in German and English.
The contract text is stored and can be retrieved online after completion of the ordering process. You will receive a copy of the terms and conditions with the invoice by e-mail with each order.
§9 Applicable law:
The relations between us and the customer are subject to the law of the Federal Republic of Germany. The UN Convention on Contracts for the International Sale of Goods, as well as other, also future intergovernmental or international conventions, shall not apply, even after their adoption into German law.
The place of jurisdiction for all disputes in connection with the delivery transaction shall be, at our option, Nagold, and for actions brought by the customer exclusively Nagold. Statutory regulations on exclusive jurisdiction remain unaffected. This agreement on the place of jurisdiction does not apply to customers who are non-merchants.
